Section 29: The Security Amendment Bill 2014

Section 29: The Security Amendment Bill 2014 section 29 sought to amend section 8 of chapter 107 of the laws of Kenya known as Registration of Persons Act.

This is what section 29 of the Security Amendment Bill 2014 looked like

Section 8 of the Registration of Persons Act is amended by inserting the following subsection immediately after —
(1A) The Director may establish identification committees or appoint persons as identification agents to assist in the authentication of information furnished by a parent or guardian.”

This is what section 8 of the Registration of Persons Act says;

Power to demand proof of information
A registration officer may require any person who has given any information in pursuance of this Act or rules made thereunder to furnish such documentary or other evidence of the truth of that information as it is within the power of that person to furnish.”

After the amendment section 8 of Cap 107 (Registration of Persons Act) of the laws of Kenya should read:-
A registration officer may require any person who has given any information
in pursuance of this Act or rules made thereunder to furnish such documentary
or other evidence of the truth of that information as it is within the power of that
person to furnish
a)      The Director may establish identification committees or appoint persons as identification agents to assist in the authentication of information furnished by a parent or guardian”

Section 64: The Security Amendment Bill 2014 section 64 sought to amend section 11c of  the National Intelligence Act .

This is what section 64 of the Security Amendment Bill 2014 looked like

“64. The National Intelligence Service Act, 2012 is amended in Section 11C by deleting the words “in accordance with Section 10(2), (3) and (4)”.

This is what section 11C of the National Intelligence Act reads

“11. (1) The office of the Director-General shall  become vacant if the holder-
(b)   dies;
(c)    resigns by notice, in writing, to the President; or
(d)   is removed by the President in accordance with section 10(2), (3) and (4).

After some editing the NIS act should read

“11. (1) The office of the Director-General shall
become vacant if the holder-
(a)    dies;
(b)   resigns by notice, in writing, to the President; or
(c)    is removed by the President”

Section 58: The Security Amendment Bill 2014

Section 58: The Security Amendment Bill 2014 section 58 sought to amend section 16 of Act no 13 of 2006 of the laws of Kenya known as Refugees Act by inserting new 4 clauses right after section 16(1)A.
This is what section 58 of the Security Amendment Bill 2014 looked like
Permitted number ofrefugees and asylum seekers in Kenya.

“58. The Refugees Act is amended by inserting the following new section immediately.

16A. (1) The number of refugees and asylum seekers permitted to stay in Kenya shall not exceed one hundred and fifty thousand persons.
(2) The National Assembly may vary the number of refugees or asylum seekers permitted to be in Kenya.
(3) Where the National Assembly varies the number of refugees or asylum seekers in
Kenya, such a variation shall be applicable for a period not exceeding six months only.
(4) The National Assembly may review the period of variation for a further six months.

This is what the original section 16(1)A of the Act No 13 of 2006 reads
16. (1) Subject to this Act, every recognized refugee and every member of his family in Kenya–
(a)    shall be entitled to the rights and be subject to the obligations contained in the international conventions to which Kenya is party;
(b)   shall be subject to all laws in force in Kenya.”
This is how section 16(1) of Act No 13 of 2006 should look after Security Amendment Bill 2014
16. (1) Subject to this Act, every recognized refugee and every member of his family in Kenya–
(a)    shall be entitled to the rights and be subject to the obligations contained in the international conventions to which Kenya is party;
                                      i.            (1) The number of refugees and asylum seekers permitted to stay in Kenya shall not exceed one hundred and fifty thousand persons.
